H&M MEMBERSHIP TERMS AND CONDITIONS
1.1 Welcome to the H&M Loyalty Program. By becoming a member, you agree to be bound by these H&M Membership Terms and Conditions (“Terms and Conditions”).
1.2 H&M membership services are provided by H & M Hennes & Mauritz (Shanghai) Commercial Co. Ltd (“H&M”).
1.3 You may register your H&M membership on the following platforms (“H&M Online Platform”):
- H&M official China site (www.hm.com.cn);
- Mobile APP “H&M Mall”;
- Wechat Mini Program “HM Online Store”;
- Wechat Mini Program “HM Membership Center”; and
- HM Tmall official flagship store (hm.tmall.com) (“H&M Tmall Store”).
1.4 The membership is free of charge and no purchase is necessary to become a member.
1.5 By being a member of the loyalty program you will earn points which qualifies you to different tiers where you can take part of offers, services, events and much more organised by H&M or H&M partner companies. As a logged in member we will give you a tailor-made experience of the H&M brand including personalized offers and recommendations distributed via email, in app messaging, Tmall messages or in your social media feed when applicable. You will find more information about current rewards and offers on the webpage of “My Account” or “Store Membership” on the H&M Online Platforms (hereinafter jointly referred to as "My Account").
1.6 You can find information regarding how H&M will process your personal data in the Personal Information Protection Policy here.
2.1 The membership is limited to individuals that are acting in a personal capacity and not in the capacity of a company, who are at least 18 years of age who are not under guardianship, or over 16 years of age who has the consent of the guardians. H&M reserves the right to request written confirmation of such consent. Employees, officers, directors, agents and representatives of H&M are eligible for membership but may be excluded from certain promotions.
2.2 By submitting your application for membership registration, you represent that you are at least 18 years of age under no guardianship, or over 16 years of age and have the consent of your guardians, and that you agree to these Terms and Conditions.
2.3 Your membership is personal, non-transferable and subject to these Terms and Conditions as well as any other rules, regulations, policies, and procedures adopted by H&M as approved by you upon taking part of offers, rewards, making purchases and other related services. We apply a limit of one membership per person.
2.4 Companies, groups, associations or other entities, or others making commercial or bulk purchases are not eligible for membership. The membership may not be used for reselling or profit.
2.5 It is your responsibility, and a condition for your membership, to keep your email and contact details up to date.
3 H&M LOYALTY PROGRAM IN CHINA
3.1 The membership is a national program and limited to purchases in H&M stores and H&M Online Platforms in the Mainland of the People’s Republic of China (for the purpose of these Terms and Conditions only, not including Hong Kong Special Administrative Zone, Macau Special Administrative Zone and Taiwan Region, hereinafter referred to as “Mainland China”). You can only earn points by shopping or by performing other point awarding activities in China as communicated from time to time by H&M. Please note that you will not earn points on purchases of gift cards.
3.2 The points you have earned are personal and cannot be transfered to another person or member.
3.3 The points earned on a purchase of an item will be deducted from your account if you return the item.
4 POINTS, TIERS AND VOUCHERS
4.1 The points you earn counts toward the second tier membership as well as toward vouchers.
4.2 The date when you become a member will constitute the “Start Date” of each “Membership Year”. The “Membership Year” is the 12 months following the Start Date of each year. The tier level of your membership is based on the points earned during the current or previous Membership Year whichever is the highest. If you are a new member, or do not have sufficient points to qualify you to the second membership tier level, your membership tier level will start at the first tier. If you reach the second tier during a Membership Year you will stay at the second membership tier level during the rest of the Membership Year and the following Membership Year. If you during the Membership Year do not accumulate sufficient points to qualify you to the second membership tier level, you will return to the first tier for the following Membership Year.
4.3 After the end of each Membership Year all points counting towards the next membership tier level will be reset and start over at 0.
4.4 The points counting towards the voucher are valid until the next Start Date.
4.5 When you have earned 500 points, a voucher of 10¥ will be issued on your My Account. You can use the voucher both in H&M Stores and H&M Online Platforms in Mainland China in line with these Terms and Conditions and the relevant rules published in the H&M stores and on the H&M Online Platforms.
4.6 The voucher will be issued 30 days after the date that the sufficient point limit is reached. You can only obtain 5 vouchers per calender months, and a maximum of 20 vouchers per 12 month period.
4.7 Vouchers cannot be excharged for cash or used for purchases that totals an amount less than the value of the voucher. The sum total of the purchase, after the voucher is applied, must exceed 1 ¥. Non-Commercial goods, such as shopping bags in store, does not count towards this sum.
4.8 The vouchers cannot be used to purchase H&M Gift Cards.
5 CHANGES, TERMINATION AND/OR REMOVAL FROM H&M LOYALTY PROGRAM
5.1 You may unbind H&M Tmall Store from your H&M Membership Account by clicking “Quit Membership” on “Store Membership” – “Membership Rules” page of H&M Tmall Store. After unbinding, you will not be able to enjoy purchase accumulative points, member-only discount and other member benefits in H&M Tmall Store. But your membership on other H&M Online Platforms remains same without any impact.
5.2 If you would like to quit your membership on all H&M Online Platforms, you need also to contact customer service to cancel your membership. Please note that cancelling your membership means that you will only be able to shop at H&M Online Platforms using the guest check-out, any points which remain in such account will be forfeited, and H&M will not be able to provide you services applicable to H&M membership under these Terms and Conditions and the Personal Information Protection Policy.
5.3 H&M may, at its sole discretion, terminate, alter, limit, suspend or modify the H&M Loyalty Program, and/or the Terms and Conditions at any time, in case of changes to applicable laws, changes in services provided by H&M or introducing new services. You will be informed of such change either on hm.com.cn, in the H&M App, via WeChat direct messages, Tmall messages, SMS, email or a combination thereof. You should read and understand the latest Terms and Conditions in time and consciously adhere thereto when you use H&M membership services. If you carry on using H&M membership services, you will be deemed to agree on any amendment hereto. If you do not accept the changes you have the right to cancel your membership.
5.4 Any proven abuse of the H&M Loyalty Program, proven or reasonably assumed fraud, failure to follow the Terms and Conditions, membership inactivity for more than 36 months, any misrepresentation or any conduct detrimental to the interests of H&M may subject you to membership revocation and will affect eligibility for further participation in the H&M Loyalty Program. If your membership is revoked, any points in your My Account will automatically expire. H&M will not be able to provide you services applicable to H&M membership under these Terms and Conditions and the Personal Information Protection Policy.
6 LIMITATION OF LIABILITY
6.1 H&M will not be liable for any system failure or malfunction of the H&M Loyalty Program or any consequences caused by Internet or public infrastructure or the malicious damage made by the third party thereof. H&M will assume liabilities for any loss or damages with the extent of laws and regulations, if any suspension, variation or termination or in any other way relating to the H&M Loyalty Program could be attributed to H&M itself.
7 APPLICABLE LAW AND JURSICTION
7.1 These Terms & Conditions shall be governed by the laws of the People’s Republic of China, without regards to any rules or principles on conflicts of laws. Any dispute, claim or controversy arising or relating to these Terms and Conditions or membership shall be resolved by the courts with jurisdiction in Shanghai, China.

These Terms and Conditions shall take effect on September 8, 2020.
